Online Gambling Licensing in Kahnawake

Kahnawake or The Kahnawake Mohawk Territory is an Indian reserve located in Quebec, Canada. The local government began to consider creating favorable environment for Kahnawake Internet gambling since the first international jurisdictions appeared. The new Kahnawake online gambling legislation model was considered to be suitable for the country and facilitated cooperation with other international regulating jurisdictions. The Interactive Gambling Act, 1998 was activated in Queensland, Australia was taken as an example for new legislation.

The licensing authority responsible for Kahnawake Internet Gambling Legislation is Kahnawake Gaming Commission. It provides Kahnawake sportsbook gambling licenses and licenses to Internet-based poker and casino. There are some general principles to  be followed within Kahnawake Internet Gambling law:

  • Suitable persons and entities are permitted to provide their operating services in the country;
  • Games to offer are fair to the players;
  • Winners are paid.

The basic principles of the KGC include:

  • Fair gaming. All gambling games provided to online players must be delivered on an honest and fair basis;
  • Payouts guarantee. Winners must be paid with their gains at all times without exceptions;
  • Geographical reference. Only certain individuals and entities have a permission to use gambling services through this jurisdiction.

Under the Regulations concerning Interactive Gaming of September 22, 2010, The Kahnawake Gaming Commission issues four types of licenses:

  1. Interactive Gaming License (IGL)

    For an approved hosting facility in Kahnawake. Only one IGL may be issued at any given time. Currently only a data centre within the Mohawk Territory Mohawk Internet Technologies holds the license.

  2. Client Provider Authorization (CPA)

    For the approved entities to provide interactive gaming services (such as casino, poker and/or sports-book) from the hosting facility in Kahnawake. The Commission may issue no limited amount of this license type. The valid holder of this license is called an Authorized Client Provider.

  3. Secondary Client Provider Authorisation (Secondary CPA)

    For the approved entities to offer interactive gaming services with their primary operations located under another jurisdiction. They should comply with all the requirements of the Commission, except showing KGC`s logo, on the web-site.

  4. Key Person Licenses (KPL)

    For at least one person responsible for managing issues in the entity with CPA. The KPL information is confidential.
